The moment you upload: AI, privacy and your school’s data

Staff files, medical certificates, performance notes, payroll. Every one of them now sits one click away from an AI feature in software your school already uses. What actually happens to that data when it goes in, and where does the Privacy Act say you stand the moment it does?

Why this session

One question, taken seriously, for a full hour.

The Martian Logic alien inspecting a long AI contract with a magnifying glass

AI in schools gets talked about in generalities. This session doesn’t. It takes the one question business managers are being asked by their boards, “is our data safe in these tools?”, and goes deep rather than wide.

The answer turns on things most of us have never had to understand before: what a model actually does with the data it’s given, which contract terms decide it, how Australia’s privacy regulator currently views the simple act of uploading and what changes when your data sits with an overseas provider.

A privacy lawyer who works these cases, an AI researcher who can explain the technology in plain language, a school business manager and a school software specialist unpack it together, with real, anonymised examples of where organisations have got into trouble.

What we’ll unpack

Four things that decide what happens the moment you upload

01

Does the AI learn from your data?

Processing, retention and training are three different things, and most people conflate them. Only one risks your information surfacing somewhere else, and it’s the vendor’s terms, not the technology, that decide which applies to you.

02

The OAIC’s view of the moment you upload

Australia’s privacy regulator has a current position on what it means to put personal information into an AI tool. It is stricter than most people assume, and it changes how you should read every vendor’s AI terms.

03

How data and IP actually walk out the door

Real, anonymised cases from a privacy lawyer’s own files: what people uploaded, why they thought it was fine and what it cost. The patterns repeat, and they are avoidable.

Where your data lives and whose law reaches it

Residency is where the servers are. Sovereignty is which government can compel access. An Australian data centre run by an overseas provider is one, not the other. For a school, that is a privacy question too.

Agenda · 60 minutes

Sixty minutes, one thread, real depth

Vendor-agnostic and practical. No product demonstrations.

  1. 5MIN

    Why this matters now

Framing from the chair: why privacy is the question underneath every AI feature your vendors are shipping.

  2. 20MIN

What happens to your data the moment you upload

How models really handle what they’re given, the regulator’s current stance and the anonymised cases where it went wrong. Lawyer and researcher together.

  3. 15MIN

Where it lives, and whose law reaches it

Residency vs sovereignty as a privacy question. What’s reasonable to demand of a vendor, and how the business office and IT divide the work.

  4. 10MIN

The privacy questions to ask every vendor

The panel distils the hour into a short checklist to take into any renewal or procurement.

  5. 10MIN

Law, technology and the school office: four perspectives, each answering a different question

01 The law

What the law requires

Privacy and cyber lawyer

Alec Christie, Partner and Head of Privacy Risk, Atmos

Hear the regulator’s current position, the contract terms that decide what happens to your data and real, anonymised examples from his own files.

02 The technology

What the technology does

AI researcher

Danny Liu, Professor of Educational Technologies, University of Sydney

Hear what a model actually does with the data it is given (training, retention, processing) in plain language, so the vendor’s answers and the regulator’s concerns make sense.
